I. Party A Wuyi University wishes to engage the service of Party B ___________________ as a Foreign Teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill
conscientiously all the obligations stipulated in it.
II. The period of service will be from the ______day of ______, 20 to the ______ day of__________, 20 .
III. The duties of Party B (according to the requirements and teaching plans of the department or school in which he/she works):

V. Party A¡¯s Obligations:
1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A¡¯s work system and regulations concerning administration of foreign experts.
2. Party A shall conduct direction, supervision and evaluation of Party B¡¯s work.
3. Party A shall provide Party B necessary working and living conditions.
4. Party A shall provide a coordinator or a liaison teacher.
5. Party A shall pay Party B¡¯s salary regularly by the month.
VI. Party B¡¯s Obligations:
1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China¡¯s internal affairs.
2. Party B shall observe Party A¡¯s work system and regulations concerning administration of foreign experts and shall accept Party A¡¯s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A¡¯s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
3. Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
4. Party B shall respect China¡¯s religious policy, and shall not conduct religious activities incompatible with the status of an expert.
5. Party B shall respect the Chinese people¡¯s moral standards and customs.
VII. Revision, Cancellation and Termination of the Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or termination the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1)Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
(2)According to the doctor¡¯s diagnosis, Party B cannot resume normal work after a continued 30-day sick leave.
4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
(1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2) Party A has not paid Party B as scheduled.
VIII. Breach Penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US$ 500 to 2,000 (or the equivalent in RMB).
If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtained Pary A¡¯s consent; if Party B cancels the contract without valid reasons, it should pay a breach penalty to Party A.
If Party A asks to cancel the contract due to events beyond control, it should get the consent of Party B; if Party A cancels the contract without valid reasons, it should pay a breach penalty to Party B.
IX. The appendix of this contract is an inseparable part of the contract and has equal effect.
X. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expenses incurred when staying on after the contract expires.
XI. Arbitration
The two parties shall consult with each other and mediate any disputes that may arise about the contract. If all attempts fail, the two parties can appeal to the Foreign Affairs Office of Wuyi University or even the Foreign Affairs Office of Jiangmen Municipal Government or the Leading Group office for Introducing Foreign Professional Personnel, a subordinate organization of the Personnel Bureau of Jiangmen Municipal Government and ask for a final arbitration.

The Treatment for the Foreign Teachers
I£®Salary
1. The salary of party B shall be determined in light of the duties to be undertaken and the professional skill demonstrated, with reference to its academic training, qualifications and experience. Party A shall inform Party B of the amount of salary before he/she consents to accept the position.
2. Salary is paid monthly, beginning on the date of the assumption of responsibilities by Party B and ending on the date of the expiration of the contract. If Party B should work less than a month, payment would be made according to the following formula: ¡° 1/30 the monthly salary ¡Á the days Party B has worked.¡±
3. Party A shall pay Party B a monthly salary of RMB .
II. While Party B is working in China, Party A shall bear the following expenses instead of Party B.
1. Party A provides Party B an apartment with a bedroom, a living room, a kitchen and a bathroom.
2. A furnished apartment with bedding, an air conditioner, a washing machine, a water heater with a shower nozzle, a TV set, a refrigerator, a telephone extension, a gas tank and cooking utilities shall be provided free of charge to Party B. Party A shall pay for a monthly electric power consumption of at most 200kw for Party B. But Party B should make up for the excess himself/herself according to his/her actual electric power consumption monthly. The cost of gas shall be borne by Party B. Daily necessities other than those mentioned above shall be borne by Party B.
3. If Party B works in Wuyi University for a whole academic year, his/her salary is paid as usual during the winter/ summer vacation. If a new contract is signed for another continuous academic year or semester, salary will be paid as usual during the summer/winter vacation before the new academic year or the new semester begins (In this case termination allowance will not be paid until the expiration of his/her final contract).
4. A total sum of 300 RMB is paid by Party A to Party B for vehicle transportation.
1. When Party B is ill and is medically certified, he/ she shall ask Party A for sick leave. Salary shall be paid as usual if Party B¡¯s sick leave totally less than 30 days during one contract period (i. e. one Semester, half a year, an academic year or a year). If sick leave should exceed that limit, Party A will have the right of proposing termination of the contract. If the contract has not been terminated, Party B will receive 70% of his/her salary from the 31st day until he/she resumes his/her normal work or until the contract expires.
2. Should Party B with the consent of the Director of the Department in advance ask for leave on account of private business, salary deduction would be made according to the number of days of absence, which should not be allowed to exceed totally over 10 days or 3 consecutive days each leave during the contract period.
3. Should Party B leave for personal reasons and miss classes, he/she must get permission first from the director of the Department and inform the Foreign Affairs Office and then go through all the procedures concerned. Party B should make up classes as agreed upon by both sides.
On the expiration of Party B¡¯s contract and on Party B¡¯s leaving for home at the end of an academic contract year of service (either from August to the following July or from February to the following January), if no new contract is signed, a termination allowance of 4000 RMB for service shall be granted to Party B as return-trip air-ticket. No termination allowance is granted for service of less than one academic year.
